Terms Of Use Agreement between User And Finchant

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.finchant.com website.

The domain name www.finchant.com (hereinafter referred to as "Website") is owned by Finchant Online Private Limited a company incorporated under the Companies Act, 1956 with its registered office at 308, Miyawala, Rural_Dehradun, Dehradun, Uttrakhand, India (hereinafter referred to as "Finchant").

Your use of the Website and services and tools are governed by the following terms and conditions ( "Terms" ) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. By mere use of the Website, You shall be contracting with Finchant Online Private Limited and these terms and conditions including the policies constitute Your binding obligations, with Finchant.

For the purpose of these Terms , wherever the context so requires "You", "User" , "Customer" shall mean any natural or legal person who has agreed to become a User on the Website by providing Registration Data while registering on the Website as Registered User using the computer systems or mobile or tablet. Finchant allows the User to surf the Website without registering on the Website. The term "We", "Us", "Our" shall mean Finchant Online Private Limited. Finchant is an internet technology company which has developed the website and app that connects the User(Customer) with Service Providers(Person Or People Or Businesses) who provides the product and services to other people. Finchant always acts as a facilitator by connecting the User with Service Providers.

When You use any of the services provided by Us through the Website, You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms of Use and shall be considered as part and parcel of this Terms of Use. We reserve the right, at Our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice to You. It is Your responsibility to review these Terms of Use periodically for updates / changes. Your continued use of the Website following the posting of changes will mean that You accept and agree to the revisions. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Website.

When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.We can also promote our products/services with you through any means like sms , emails or any other mode of communication, electronic or otherwise.

We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.

Membership on the Website is free for user. Finchant does not charge any fee for browsing renting on the Website. Finchant reserves the right to change its Charges Policy from time to time. In particular, Finchant may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event Finchant reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Charges Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all Prices shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to Finchant Online Private Limited.

 

ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.By impliedly or expressly accepting these Terms of Use, You also accept and agree to be bound by Finchant Policies as amended from time to time.

 

(1)User

(1.1)The one who has registered on Finchant website by providing Registration Data while registering on the Website as Registered User using the computer systems or mobile or tablet considered to be the User. The following agreement is between the user and Finchant. The agreement governs the terms and conditions of usage of Finchant services such as our website and android application.


(2)Eligibility And Accounts

(2.1)Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the Finchant website and shall not use the website. Finchant reserves the right to terminate your account or refuse to provide you with access to the Website if it is brought to Finchant's notice or if it is discovered that you are under the age of 18 years.

(2.2)If You use the Website, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website.

(2.3) It is mandatory for every user to register on our website or through our android application on a mobile device. Users are responsible for providing and maintaining current email, contact number, address, and other account information at the time of registration. A user will be permitted to book a services only after he/she has obtained a registered account on the Finchant website or mobile application.

(2.4)While registering on the Website, the User will have to choose a password to access that User's account and User shall be solely responsible for maintaining the confidentiality of both the password and the account as well as for all activities on the account. It is the duty of the User to notify Finchant immediately in writing of any unauthorized use of their password or account or any other breach of security. Finchant will not be liable for any loss that may be incurred by the User as a result of unauthorized use of the password or account, either with or without the User's knowledge. The User shall not use anyone else's account at any time.

(2.5)User understands that any information that is provided to this Website may be read or intercepted by others due to any breach of security at the User's end.

(2.6)Finchant adopts the best industry standard to secure the information as provided by the User. However, Finchant cannot guarantee that there will never be any security breach of its systems which may have an impact on User's information too.

(2.7)The data of the User as available with Finchant may be shared with concerned law enforcement agencies for any lawful or investigation purpose without the consent of the User.

(2.8) If the User does not agree with any part of this Agreement, then the User must not avail Finchant's services and must not access or approach the Sales Channels of Finchant.


(3)User's Responsibility

(3.1)Users are advised to check the description or terms of the services and products carefully before making a booking. User(s) agree to be bound by all the conditions as contained in booking confirmation or as laid out in the service or product details page. These conditions are also to be read in consonance with the User Agreement.

(3.2)If a User intends to make a booking on behalf of another person, it shall be the responsibility of the User to inform such person about the terms of this Agreement, including all rules and restrictions applicable thereto.

(3.3)The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations of the concerned jurisdiction regarding use of the services for each transaction.

(3.4)The services are provided on an "as is" and "as available" basis. Finchant may change the features or functionality of the services being provided at any time, in its sole discretion, without any prior notice. Finchant expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, reasonably fit for all purposes. No advice or information, whether oral or written, which the User obtains from Finchant or through the services opted shall create any warranty not expressly made herein or in the terms and conditions of the services.

Finchant reserves the right to make any necessary changes in the terms and conditions of the agreement without any prior notice. In the case of any alterations to the agreement, the user will be notified through on the Finchant website or Mobile Application. An email will also be sent to the user.

(3.5)It is considered that a user has read and agreed to the latest terms and conditions at the time of booking the vehicle. A booking is confirmed once the payment has been processed and any such payment is considered an agreement by the respective user to abide by the terms and conditions mentioned herein or in terms and conditions page and on vehicle details page. In case a user is found to violate any criteria listed in this document, or in terms and conditions page. Finchant may revoke his/her membership and/or refuse service without any prior notice.

(3.6)For Booking done on call, it is considered that a user has read and agreed to the latest terms and conditions before making call to Finchant.com. Once the payment has been processed and any such payment is considered an agreement by the respective user to abide by the terms and conditions mentioned herein or in terms and conditions page and on vehicle details page. In case a user is found to violate any criteria listed in this document, or in terms and conditions page. Finchant may revoke his/her membership and/or refuse service without any prior notice.

(3.7)User also authorizes Finchant's representative to contact such user over phone, message and email. This consent shall supersede any preferences set by such User through national customer preference register (NCPR) or any other similar preferences.

(3.8)User also authorizes Finchant's Service Provider to contact such user over phone, message and email. This consent shall supersede any preferences set by such User through national customer preference register (NCPR) or any other similar preferences.


(3.9)By making a booking, User understands Finchant merely provides a technology platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not Finchant. Thus the ultimate contract of service is between User and Service Provider.


(4)Limited Liability Of Finchant

(4.1)Finchant is an internet technology company which has developed the website and app that connects the User(rentee or customer) with Service Providers(Individual Person Or People Or Businesses) who provides services to other people. Finchant always acts as a facilitator by connecting the User with the respective service providers of like scooters, bikes and cars . Finchant's liability is limited to providing the User with a confirmed booking as selected by the User.

(4.2)Any issues or concerns faced by the User at the time of availing any such services shall be the sole responsibility of the Service Provider. Finchant will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on part of any Service Provider.

(4.3)Unless explicitly committed by Finchant as a part of any product or service:

   (4.3a) Finchant assumes no liability for the standard of services as provided by the respective Service Providers.
   (4.3b) Finchant provides no guarantee with regard to their quality or fitness as represented.
   (4.3c) Finchant doesn't guarantee the availability of any services as listed by a Service Provider.

(4.4)By making a booking, User understands Finchant merely provides a technology platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not Finchant. Thus the ultimate contract of service is between User and Service Provider.

(4.5)If the User disagree with the above mention points User does not use Finchant's platform (website/app) to get any services.


(5)Fees And Payments

(5.1)In addition to the cost of booking as charged by the Service Providers, Finchant reserves the right to charge certain fees in the nature of convenience fees or service fees. Finchant further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.

(5.2)In cases of short charging of the booking amount, taxes, statutory fee, convenience fee etc., owing to any technical error or other reason, Finchant shall reserve the right to deduct, charge or claim the balance amount from the User and the User shall pay such balance amount to Finchant. In cases where the short charge is claimed prior to the utilization of the booking, Finchant will be at liberty to cancel such bookings if the amount is not paid before the utilization date.

(5.3)Any increase in the price charged by Finchant on account of change in rate of taxes or imposition of new taxes, levies by Government shall have to be borne by the User. Such imposition of taxes, levies may be without prior notice and could also be retrospective but will always be as per applicable law.

(5.4)In the rare circumstance of a booking not getting confirmed for any reason whatsoever, Finchant will process the refund of the booking amount paid by the User and intimate the User about the same. Finchant is not under any obligation to provide an alternate booking in lieu of or to compensate or replace the unconfirmed booking. All subsequent bookings will be treated as new transactions. Any applicable refund will be processed as per the defined policies of the service provider and Finchant as the case may be.

(5.5)The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the service, as per the applicable laws.

(5.6)The User agrees and understands that all payments shall only be made to bank accounts of Finchant. Finchant or its agents, representatives or employees shall never ask a customer to transfer money to any private account or to an account not held in the name of Finchant. The User agrees that if that user transfers any amount against any booking or transaction to any bank account that is not legitimately held by Finchant or to any personal account of any person, Finchant shall not be held liable for the same. User shall not hold any right to recover from Finchant any amount which is transferred by the User to any third party.

(5.7)The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of Finchant. The User shall immediately inform Finchant if such details are demanded by any of its agents' employees or representatives. Finchant shall not be liable for any loss that the User incurs for sharing the aforesaid details.

(5.8)Refunds, if any, on cancelled bookings will always be processed to the respective account or the banking instrument (credit card, debit card, wallet, upi etc.) from which payment was made for that booking.


(6)Mobile Number Usage For Communication

(6.1)Finchant will send booking confirmation, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the User, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.

(6.2)Finchant may also contact the User through the modes mentioned above for any pending or failed bookings, to know the preference of the User for concluding the booking and also to help the User for the same.

(6.3)The User hereby unconditionally consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by Finchant are:

(6.3a)Upon the request and authorization of the User;
(6.3b)'Transactional' and not an 'unsolicited commercial communication' as per the guidelines of Telecom Regulation Authority of India (TRAI), and
(6.3c)In compliance with the relevant guidelines of TRAI or such other authority in India and abroad.

(6.4)The User will indemnify Finchant against all types of losses and damages incurred by Finchant due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous complaint raised by the User on Finchant with respect to the communications mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.

(6.5)The User agrees that his/her contact number can be shared with Service Provider for Contacting the user for Delivery/Pickup of Vehicle and to confirm booking with the user.


(7)Right To Refuse

(7.1)Finchant at its sole discretion reserves the right to not accept any booking without assigning any reason thereof. Finchant will not provide any service or share confirmed booking details till such time the complete consideration is received from the User.

(7.2)In addition to other remedies and recourse available to Finchant under this User Agreement or under applicable law, Finchant may limit the User's activity, warn other users of the User's actions, immediately suspend or terminate the User's registration, or refuse to provide the User with access to the Website if:

(7.2a)The User is in breach of this User Agreement;
(7.2b)Finchant is unable to verify or authenticate any information provided by the User;
(7.2c)Finchant believes that the User's actions may infringe on any third-party rights or breach any applicable law or otherwise result in any liability for the User, other users of Finchant, or Finchant itself.

(7.3)Once a User has been suspended or terminated, such User shall not register or attempt to register with Finchant with different credentials, or use the Website in any manner whatsoever until such User is reinstated by Finchant. Finchant may at any time in its sole discretion reinstate suspended users. If a User breaches this User Agreement, Finchant reserves the right to recover any amounts due to be paid by the User to Finchant, and to take appropriate legal action as it deems necessary.

(7.4)The User shall not write or send any content to Finchant which is, or communicate with Finchant using language or content which is:

(7.4a)Abusive, threatening, offensive, defamatory, coercive, obscene, belligerent, glorifying violence, vulgar sexually explicit, pornographic, illicit or otherwise objectionable;
(7.4b)Contrary to any applicable law;
(7.4c)Violates third parties' intellectual property rights;
(7.4d)In breach of any other part of these terms and conditions of use.

(7.5)If the User violates any of the aforesaid terms, Finchant shall be at liberty to take appropriate legal action against the User.


(8)Right To Cancel

(8.1)The User expressly undertakes to provide Finchant with correct and valid information while making use of the Website under this User Agreement, and not to make any misrepresentation of facts. Any default on part of the User would disentitle the User from availing the services from Finchant.

(8.2)In case Finchant discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of the travelers is not correct or that any fact has been misrepresented by that User, Finchant shall be entitled to appropriate legal remedies against the User, including cancellation of the bookings, without any prior intimation to the User. In such an event, Finchant shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.

(8.3)If any judicial, quasi-judicial, investigation agency, government authority approaches Finchant to cancel any booking, Finchant will cancel the same without approaching the concerned User whose booking has been cancelled.

(8.4)The User shall not hold Finchant responsible for any loss or damage arising out of measures taken by Finchant for safeguarding its own interest and that of its genuine customers. This would also include Finchant denying or cancelling any bookings on account of suspected fraud transactions.


(9)Force Majeure

(9.1)There can be exceptional circumstances where Finchant and / or the Service Providers may be unable to honor the confirmed bookings due to various reasons like act of God, labor unrest, insolvency, business exigencies, government decisions, pandemic, terrorist activity, any operational and technical issues, route and flight cancellations etc. or any other reason beyond the control of Finchant. If Finchant has advance knowledge of any such situations where dishonor of bookings may happen, it will make its best efforts to provide similar alternative to the User or refund the booking amount after deducting applicable service charges, if supported and refunded by that respective service providers. The User agrees that Finchant being merely a facilitator of the services and products booked, cannot be held responsible for any such Force Majeure circumstance. The User has to contact the Service Provider directly for any further resolutions and refunds.

(9.2)The User agrees that in the event of non-confirmation of booking due to any technical reasons (like network downtime, disconnection with third party platforms such as payment gateways, banks etc.) or any other similar failures, Finchant's obligation shall be limited refunding the booking amount, if any, received from the customer. Such refund shall completely discharge Finchant from all liabilities with respect to that transaction. Additional liabilities, if any, shall be borne by the User.

(9.3)In no event shall Finchant and be liable for any direct, indirect, punitive, incidental, special or consequential damages, and any other damages like damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Website or any other Sales Channel.


(10)Indemnification

(10.1)The User agrees to indemnify, defend and hold harmless Finchant, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant by the User.

(10.2)The User shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and Finchant cannot be held responsible for the same.


(11)Arbitration, Dispute Settlement & Jurisdiction

(11.1)Any disputes or differences arising out of or pertaining to this Agreement, shall first be mutually resolved by the parties(Finchant & User) through amicable discussions, failing which through a sole arbitrator having summary powers, appointed by the statutory auditors of Finchant, arbitration proceedings of which shall be conducted in Dehradun in English language in accordance with the provisions of the Arbitration & Conciliation Act, 1996 and /or any amendments thereto.

(11.2)Any disputes /difference not being the subject matter of such Arbitration proceedings shall be subject to the jurisdiction of the Courts of law at Dehradun alone.

(11.3)Finchant shall be entitled to add to, vary or amend any or all of these terms and conditions at any time and "Service Provider" shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these Terms and Conditions or updated on the Finchant Platform on the date that Finchant may indicate that such addition, variation or amendment is to come into effect.

(11.4)Any disputes arising from or connected herewith shall be subject to the exclusive jurisdiction of the competent courts at Dehradun, Uttarakhand, India.


(12)Adhaar Card Number and Driving License Number

(12.1) By submitting Aadhaar number & Driving License number to Finchant, you hereby authorize Finchant to collect, encrypt, store and authenticate your Aadhaar number and demographic details (Information) against UIDAI database by itself. You also hereby authorize Finchant to collect, encrypt, store and authenticate the Driving License number with the mParivahan database.

(12.2) Finchant will use your aadhar number & Driving License number to verify your identity.

(12.3) Finchant may share the Aadhaar & Driving License data with government law enforcement agencies in case of any legal case/theft etc.


(13)Severability

If any provision of this User Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this User Agreement shall continue to be in full force and effect.


(14)Amendment To User Agreement

Finchant reserves the right to change the User Agreement from time to time. The User is responsible for regularly reviewing the User Agreement.


(15)Confindentiality

Any information which is specifically mentioned by Finchant as confidential shall be maintained confidentially by the User and shall not be disclosed unless as required by law or to serve the purpose of this User Agreement and the obligations of both the parties herein.


(16)Feedback

Finchant would like to know the feedback of the Users for improving its services. The User hereby authorizes Finchant to contact the User for their feedback on various services offered by Finchant. Such feedback may be collected through emails, telephone calls, SMS or any other medium from time to time.

 

 

 

Terms And Conditions For Self Driven Vehicle

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

For the avoidance of doubt, ‘you’ or 'User' refers to the main driver, the person paying for the rental and/or the person making the booking.The term "We", "Us", "Our" shall mean Finchant Online Private Limited Or Finchant. Please note, although ‘you’ may refer to more than one person, we contract with all parties, but we will only be able to speak to the main driver in respect of a confirmed booking.

In respect of the Services, when You make a Booking of self driven vehicle, we enter into a separate contract with You on behalf of the Service Provider as its disclosed agent, and the Service Provider is the principal. Together, these are referred to as ‘our terms’. The Service Provider’s house rules and cancelation policy (the “Service Provider Policies”) will also apply to the contract, unless stated otherwise in these Terms. We may change the terms from time to time and you are advised to check the website to consider any changes to the terms which apply to you. Your hire of any self driven vehicle is subject to the terms & conditions of self driven vehicle imposed by the self driven vehicle service provider and to the corresponding laws of the country and/or state in which the rental takes place. Individual restrictions may also apply to your self driven vehicle hire.


These terms apply to any booking that you make with us on or through Finchant's website/app, so you should make sure that you are aware of their contents. Both our terms and those of the self driven vehicle service providers we work with contain some exclusions and limitations of liability.


User

The User considered as the main driver of the vehicle. The user automatically after doing booking is agreeing on this rental terms. If you do not agree with any part of them, you must not proceed with your booking. By confirming that you wish to book a self driven vehicle through Finchant's website you indicate that you have read and understood and accept our terms. If there is any part that you do not fully understand, or if you have a query about the self driven vehicle hire or any other product, please Contact us.


Age

The user must be above 18 years. However, certain vehicles from diffrent service providers are provided at the minimum age of 21 or 23.

Finchant retains the right to refuse membership to any applicant, even if he/she satisfies the above criteria. Granting of membership is solely on the discretion of Finchant.

Self Driven Vehicles on Finchant's website should be driven only by Finchant members. If a person is not registered on Finchant as an active member, he/she will not be allowed to drive the vehicle.
 

Documents Required

The user must have a valid driving license issued by the Government of India. The user must scan his/her license and upload it on our website/app.

The user must carry his/her original DL & Alternate ID proof(Aadhaar Card,Pan Card, Voter Id & Passport) at the time he/she takes possession of the vehicle.

Only Documents issued by the government of India such as Voter ID, Driver’s license,Pan Card, Aadhaar Card & Passport will be considered as valid ID proof only.

If a user is unable to verify his/her identity, the booking shall be considered void by Finchant. Finchant reserves the right to cancel the booking. The user must present their Original Driving License to the authorised Finchant Service provider at the pickup point. The possession of vehicle will not be granted to a user in case he fails to meet the above requirements.

A photograph(s) of the user and the documentation that they provide will be taken at the time of vehicle pick-up, for security purposes. This is to avoid cases of fraud & theft. These photographs will not be shared with any third parties and will only be used for identifying the user under the purview of the trip that they take with Finchant.


Accuracy Of Information

The User expressly undertakes to provide Finchant with correct and valid information while making Booking on Finchant website/app, and not to make any misrepresentation of facts. Any default on part of the User would disentitle the User from availing the self drive vehicle rental services from Finchant.

In case Finchant discovers or has reasons to believe at any time during or after receiving a booking request for self drive vehicle rental services from the User that the request for self drive vehicle rental services is either unauthorized or the information provided by the User or any of the travelers is not correct or that any fact has been misrepresented by that User, Finchant shall be entitled to appropriate legal remedies against the User, including cancellation of the bookings, without any prior intimation to the User. In such an event, Finchant shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.

The User shall not hold Finchant responsible for any loss or damage arising out of measures taken by Finchant for safeguarding its own interest and that of its genuine customers. This would also include Finchant denying or cancelling any bookings on account of suspected fraud transactions.


Bookings

All bookings have to be made solely by the registered user themselves via Finchant's Website, Android platforms well in advance and prior to pick up. Bookings are processed by Finchant's system automatically on a first come first serve basis. Finchant does not guarantee the availability of any particular vehicle at any given time. Vehicle availability is dynamically updated in Finchant's system to reflect real-time changes.

In case if any additional charges are to be paid, we strongly recommend to make payment Online via credit/debit card.

Extension will be granted if and only if the vehicle is available for the requested period of time.

An extension to the rental period of the vehicle will be granted subject to availability. The charges for the extension period will be applicable as per rates given on the website or app at given time.

All expenses incurred during the rental period on the vehicle such as parking fee, fine, challans, inter state taxes, tolls etc. will be borne by the user.

Finchant allows a user to book a vehicle for distance mention on the details page of vehicle. Under this, user can drive distance without any extra rental charges. Different for different service provider check on vehicle details page.

The user will get the vehicle with some fuel or full fuel in fuel tank or half fuel in fuel tank. He/She has to return it in same condition or similar level as provided to the user during the vehicle handover. If Fuel level is below the mention level User will charged for how much litre is less. Basically Fuel cost to be borne by the user.


Security Deposit

Finchant Service provider require a deposit at the start of the rental to cover the liability excess, any charges incurred during the rental and, in some cases, fuel. In order to make the deposit you will usually be required to have a valid credit card with available funds on it or you can provide it in cash or through digital payment methods like wallet or upi. This security deposit refunded during return of the car.


Pickup And Return Of Vehicle

The user can collect the pre-booked vehicle from the designated Finchant service provider after verifying his/her identity and on completing the requisite paperwork. Booking time is calculated from the time period mention in user account. Prior to taking possession, it is the User's responsibility to inspect the vehicle carefully. In the event of any damages or malfunction, the user should inform service provider and Finchant immediately.

If a user opts for delivery at desired location, a delivery charge will be levied as mention in vehicle details page. If a user opts for self pickup then there is no charge.

It is the responsibility of the user to return the vehicle in the same condition as at the time of pickup. In case the interior and/or the exterior of the vehicle is found to be soiled and/or damaged, cleaning charges and/or penalty will apply accordingly depending on the extent of the damage, to be decided by service provider after the ride has ended.

Finchant requests its users to kindly check all the features of the vehicle. In the event of any queries, the user is free to contact a Finchant customer care. In case the user is dissatisfied with the performance of the vehicle, he/she must inform a Finchant customer care at the time of pickup. In such an event the user will be provided an alternate vehicle of his/her choice as per availability. In case no alternate vehicles are available, the booking deposits will be reimbursed to the user’s bank account as per specified by the user at the time of booking.

The user must return possession of the vehicle at the pickup point from which it had pick the vehicle. In order to return possession, the user must hand over the keys of the vehicle to a Finchant service provider at the designated parking space. If the keys are not returned, Finchant will consider that the user is yet to return possession and the user will be billed accordingly. In case the user fails to return the vehicle on time for any reason whatsoever, penalty charges will apply accordingly.


Rental Period & Charge

The Rental Period will be as for which the user booked the vehicle on the website/app. Rental charges calculated on the basis of 24-hour. Per day time period i.e 24 hours or 12 hours, different for different service provider visit vehicle details page to know.

Buffer time/Extra Time will be provided as per service provider credention,different for different service provider. Details on vehicle details page.

Minimum booking duration for a vehicle(bikes or scooters or cars)  is 12 hours.

Charges will apply on the time period for which the vehicle has been booked by the user as per rates given on the website.


Buffer Time and Late charge

Buffer time/Extra Time will be provided as per service provider credention,different for different service provider. Details on vehicle details page. Beyond Buffer time the late charge is charged by the service provider which is mention on the vehicle details page.


Extension

If you wish to extend the period of hire after picking the car up, or if you drop the car off later than stated on your rental period by the days then it will only be provided on the current rates, subject to availability of the vehicle. Current rates can be diffrent from the rates at the time of booking. You can contact us or service provider for the same.

If you wish to extend the period of hire by drop the car off later than stated on your rental period by some hours you can contact service provider directly and the late charge will be charged by the service provider according to its buffer time and late charge policy mention in vehicle details page.

Your rental starts and finishes according to the pick-up and drop-off dates and times detailed on your rental period. Unfortunately, we are unable to provide refunds for unused time if a car is picked up late or dropped off early. If you are unable to pick the car up at the agreed time and date, it is essential you contact us as soon as possible. If you do not, there is no guarantee that the car will still be available – and you will not be entitled to any refund.


Amendments (changes to your booking)

You can make changes to your booking after the booking rent amount is paid only when there is equal to or more than 7 days to pickup the vehicle.

You can not make changes to your booking after the booking rent amount is paid and there is less than 7 days to pickup the vehicle. Except If you wish to extend the rental period of hire and it will also be on subject to availability of the vehicle.


Refund And Reimbursement And No-Show

Finchant is not liable to reimburse any expenses to user due to any vehicle breakdown, accident, damage or issues caused due to the vehicle or service.

The user will be given a refund in the following cases:

    When a booking is cancelled by the user through the customer care and   request a cancellation.

    After charging our cancellation fees as mentioned below, any remaining amount paid for the booking will be processed to the user bank account. The refund will be processed within a maximum timeframe of 7-14 working days.

    For cancellation policy refer to Cancellation And Refund Policy Section.

    In case a user fails to show up for his reservation or cancels the ride 24 before the pickup time, the booking shall be treated as a No Show no amount will be reimbursed.

    In case a ride is cancelled due to inability to produce an Original valid license or valid Govt. Id during ride pickup, 100% deductions will be applicable.

    If a user with blocked license makes a booking, the ride would be cancelled with 100% deductions.

    When a booking is cancelled by service provider Or by Finchant due to unavailability of vehicles:

        At times when we are unable to provide a vehicle for a booking due to reasons such as accident, damage, service, late handover by previous user etc. We will process a full refund of the entire amount of the booking back to the original method of payment excluding the convenience charge. The refund will be processed within a maximum timeframe of 7-14 working days.

        But we always make sure the user receive the vehicle.

The user will be given a reimbursement in the following cases by service provider(But do inform service provider before doing any repair):

    Minor repairs such as changing bulbs or refilling of coolant.

    The user must submit a printed original receipt with his/her name written on it. Handwritten receipts or receipts without the name of the user will not be entertained. The receipt must be handed over to a Finchant service provider while the vehicle is being returned. Late submission of receipts will not be entertained by the service provider. Receipts will be verified to validate expenses that occurred during the time of the issue or booking.

A ‘No-show’ is when you:

    wish to cancel but don’t tell us before your rental is due to start, or
    fail to pick the car up at the arranged time and date, or
    fail to provide the documentation that’s required to pick the car up, or
    fail to provide a credit card in the main driver’s name with enough available funds on it for the car’s deposit.

In all instances of a ‘No-show’, you’ll receive no refund of the money you’ve paid.


Vehicles Use

Self Driven Vehicles on Finchant's website are solely for the purpose of personal use. The vehicle cannot be used as a taxi or for transporting people for monetary gain. Vehicles on Finchant's website cannot be used for races, exhibitions and/or any contests.  Vehicles on Finchant's website cannot be used for towing, pushing and/or propelling another vehicle or object. Vehicles on Finchant's website cannot be used for For the purpose of transportation of any goods including any flammable, poisonous, or otherwise hazardous substances.

Vehicles on Finchant's website cannot be used by a person under the influence of (a) Alcohol and/or (b) Any mind altering substance which can impair the user’s ability to drive. Use of narcotic substances is strictly prohibited. If a user is found to be under the influence of these substances, Finchant service provider will not grant possession of the vehicle to the user. The booking fee will be reimbursed to the user’s account as per Finchant’s Refund Policy and the user can be blocked from making any bookings with Finchant. Incase users consume alcohol after the ride has started and gets into any unexpected events the User will be solely responsible for all outcomes thereon (Insurance liability, third party damages, self damages, police involvements etc).

Users will not be allowed to carry the following items on the vehicle: Weapons or any sharp or inflammable object which may cause damage to the vehicle or endanger human life. Any item/object whose possession has been deemed illegal by the Indian Penal Code. Any item or object which compromises the stability, safety or performance of the vehicle and/or the passengers. Finchant service provider holds the right to refuse a booking if the user is found to possess any of the above items. The vehicle will not be used in a negligent or abusive manner. In the case of non-compliance, appropriate actions may be taken against the user by the concerned authorities.

Vehicles on Finchant's website can be used only in the Republic of India. Use of the vehicles is subject to the laws of India. The vehicle cannot be driven in areas where entry is prohibited by the central or state government. The user must ensure that the number of passengers in the vehicle does not exceed the seating capacity of the vehicle. As a guide, please refer to the website for approximate capacities of the various car classes. We cannot accept responsibility if the Service Provider refuses to supply a vehicle because the party size is too big. In case of non-compliance, the entire sum of security deposit will be retained by Finchant.

The vehicle cannot be used for any activity which is deemed illegal by the Indian Penal Code. The terms of vehicle use listed above are non-exhaustive. Any activity judged inappropriate by Finchant in its sole discretion will be deemed as a violation of agreement. Illegal use of the vehicle will be reported to the concerned authorities by Finchant followed by the suspension or termination of service immediately.

Using a cell phone or any other mobile communication device in any manner while driving, including sending an SMS, emailing, using a cell phone with or without a hands-free device, otherwise using a mobile communication device or engaging in similar activities that may be prohibited under Applicable Laws.

For the purpose of transporting objects that could – due to their size, shape, or weight – adversely impact the vehicle’s handling safety or that could damage the interior of the Vehicle or, by virtue of such object/s protruding outside, affect the safety of vehicles driving in the vicinity of the Vehicle.

Use of tobacco, drugs or psychotropic substances inside Vehicles is absolutely prohibited. Users are subject to payment of penalties if evidence of smoking, chewing, or dipping is found in Vehicle.

Hazardous Nature: - Burning any substance including tobacco, incense etc. inside Vehicles is absolutely prohibited.

Animals are prohibited in Vehicles. Users are subject to payment of penalties in the event it is determined that the Vehicles have been used for transportation of animals.

Any kind of activity by any person which will affect the normal conditions of the vehicle.


Driving Areas

Restrictions may be applicable when taking the self driven vehicle to a different state/districts; our Contact Centre must therefore be advised at the time of booking whether you intend to do this. Additional documentation may be required and local charges may apply for travel to certain state/districts.


Safety

The Safety of Finchant users and passengers is a top priority. All vehicles are examined periodically in order to ensure that they are in compliance with India’s vehicle safety standards.

Finchant expects its users to ensure the following to help us avoid safety issues: (i) The user must ensure that all passengers wear safety belts or helmets. (ii)The number of passengers must not exceed the seating capacity of the vehicle. Finchant reserves the right to fine or block a user due to non-compliance of the above.

Finchant or Service provider is not responsible for any accident and/or injury caused to the driver and/or any of the passengers due to personal negligence or negligence of the driver. And user should inform the service provider and finchant customer care. User will be solely responsible for all outcomes thereon (Insurance liability, third party damages, self damages, police involvements etc).


Securing The Vehicle

The user is responsible for the security of the vehicle. The user is held liable to ensure that the vehicle is adequately protected from expected adverse weather conditions and is parked in areas taking appropriate precautions to avoid any untoward incidents.

In the event of theft, the user must report the incident to Finchant and service provider immediately. The user should pay the complete market cost of the vehicle to service provider. If user is not paying the cost of the vehicle appropriate action may be taken by the concerned authorities, legal or otherwise against the user.

The user must ensure the safety of all equipment in the vehicle which has been provided by service provider. In case any equipment is misplaced by the user, he/she will be charged for the same at the discretion of Finchant by the service provider.

In case the vehicle is equipped with a GPS navigation system, it is the duty of the user to remove the device from the dashboard and store it in the glove box. In case of preventable theft of the GPS device, the user will be charged a penalty as per the discretion of Finchant.

The user is responsible for the safety of their belongings. Any item, electronic device or personal belonging left in the vehicle will be returned to the user (if found) after due verification. Finchant however does not guarantee the return of any items left behind.


Cleanliness And Maintenance

Finchant service provider conducts periodical checks on vehicle performance and ensures that hired vehicles are clean. Finchant expects its users to help us maintain our standards of cleanliness. The user must ensure that the vehicle is not soiled while returning possession.

Use of chewing gum, tobacco or any tobacco based product inside the vehicle is strictly prohibited. Users will be penalised in case ash, spit marks or remains of chewing gum are detected inside the vehicle at the time when possession of the vehicle is returned.

Burning of any substance inside the vehicle is strictly prohibited. This is not limited to but includes cigarettes, incense sticks or any form of medication/drugs.

Finchant reserves the right to block, penalise, fine the user at our own discretion in event of non-compliance of the above points.


Breakdown And Failure

In the event of vehicle breakdown or member failure, the user should inform service provider (From whom vehicle is taken)immediately before getting any repairs done. The original bill is required to claim the reimbursement for the same. Tyre Puncture repair will be done by the user .

In case the vehicle cannot be repaired at the location of breakdown, a replacement vehicle will be provided by service provider, subject to availability and within 30km radius of pickup points.

The user will have to bear the expenses of towing, repair and other costs if the breakdown is due to customer negligence.

For any issues that the user experiences with the vehicle mechanical/electrical condition, we urge the user to bring it to our attention by informing our Customer Contact Centre or service provider. Issues that are brought to our attention within 30 kms of the ride start point will be duly noted and hence considered as a valid issue with the vehicle. Issues that are brought to our attention or informed of beyond 30 kms of the ride start point will be considered to have occurred due to negligent, harsh, rash, incorrect use of the vehicle by the user as member failure. Issues with engine components, particularly that of clutch, will be noted only if brought to our attention within 30 kms of the ride start point.

This list is non-exhaustive due to the variability in issues caused as part of any vehicle and Finchant is not responsible for any claims of reimbursement for issues.

Your hire of any vehicle is subject to the terms & conditions of vehicle imposed by the vehicle service provider and to the corresponding laws of the country and/or state in which the rental takes place. You  will therefore be subject both to our terms and to those of the vehicle service provider. We accept no responsibility for and shall not be liable in respect of any loss, damage, alterations, delays or changes arising from civil strife, industrial disputes including air traffic control disputes, terrorist activity, natural or nuclear disaster, pandemic, fire or adverse weather conditions, unavoidable technical problems with transport, closure or congestion of airports or ferry ports, cancellation of scheduled flights or financial failure of airlines.


Traffic Rules Violation And Other Incidents

It is the responsibility of the user to inform Finchant and service provider in case of any incident which has caused damage to the vehicle and/or any public or private property or any incident which has caused injury to individual(s) and/or animal(s). The user is solely resposible or liable to pay for the expenses or damages.

In such an event the user must provide the following details to service provider: Name, address and the license number of the user driving the vehicle at the time of the incident. Name, address and contact number of witnesses (if any). Circumstances of the incident describing the immediate environment of the incident and position of the vehicle prior to the incident. In the event of any lawsuit, users are expected to assist the authorities with investigations (if any). In case any lawsuit against a user is proved in the court of law, Finchant reserves the right to revoke membership of the individual. And Finchant is not involve in it or responsible for it.

The user is responsible for traffic rule violations (if any). This includes but is not limited to wrong parking, over speeding, breaking red light at a crossing and toll violations. The user is liable to pay any penalty charges involved. In the event of toll violation, the user must inform Finchant immediately. If Finchant learns of such an event from a third party, the user will be informed though an e-mail. The user must bear the relevant fine to the concerned authority and submit a proof of compliance to Finchant. In case the user has prior knowledge of such violations, Finchant is not obligated to inform the user. The responsibility of any unreported traffic rule violation rests solely with the user and Finchant will not bear any responsibility whatsoever.

In case of any accident/total loss of the vehicle, it is mandatory that the user should pay for the costs of the vehicle to service provider.


Penalties

Penalty charges apply in case the user retains the vehicle beyond the rental period for which the vehicle has been booked by the user on the website.

If the user damages the vehicle all the costs will be borne by the user. Charges will be deducted from the user security deposit and if the damage costs exceeds the security deposit than user will pay the cost to the finchant service provider while returning the vehicle.

Damage charges apply in case of damage to the vehicle, it depends on the severity of the damage. However, the maximum liability that the user is liable to pay in case of a major damage is cost of the vehicle . Towing cost will be charged extra.

Damage Charges will be charged by the service provider.

If a customer is found drunk at the time of drop , Rs.1000/- fine will be levied along with the damage cost. Also, the customer will be liable for the complete damage repair cost.

Customers are required to drop the vehicle at the drop location chosen at the time of booking. Failing to do so, he will be fined Rs.1500/-. Additionally, overtime charges will be fined if another booking coincides with the booking.

Smoking is strictly prohibited in and around the vehicle. Penalty of Rs.1000/- fine will be charged,if found guilty.

Finchant shall bear no penalty imposed on the vehicle due to negligent driving on part of the user.

Parking challans, if any will have to be borne by the user.

In the event of clutch plate damage, the customer will be liable to pay for the damage cost of clutch.

In the event of any traffic rule violation or parking fine, the member must inform service provider immediately. Finchant/service provider may ask for a copy of the challan in such an event. Cost will be borne by the user.

Pets are not allowed in Vehicles on Finchant's website. A fine of Rs. 500 will be levied In such cases.

If the user damages or misplaces any attachment or accessory provided with the vehicle, service provider reserves the right to charge the appropriate amount from the user.

A fine of Rs. 500 will be levied from the customer if the number plate is found damaged.

If the user has incurred any dues over and above that of the initial booking amount when dropping off the vehicle at the drop off site location and is unable to settle the dues at that time, then the user will have to sign a declaration provided by service provider promising to settle the dues and leave the original documents of license, government ID, etc. as surety. The documents can be collected by the user from the site location once dues have been settled.

In the event of user having any penalties/dues outstanding with Finchant, Finchant reserves the right to charge reminder fees and default interest. Finchant also reserves the right to utilize third parties for the recovery of dues from a user.

Finchant reserves the right to prohibit a user from booking any rides until all dues associated with the user account have been paid to Finchant in full.

The user would be charged with a penalty in case any accessory such as music system, stepney, tools or documents, belonging to vehicle is found missing during the end ride.

In the event of theft the user is liable to pay in full for the market cost of the vehicle rented to service provider.

Any external damage done to vehicle after renting due to accident/mishandling/carelessness of the user. The user is liable to pay for it and deducted from the security amount.If security deposit is not charged then user has to pay for it during returning the vehicle to the service provider.

Any internal damage done to vehicle after renting due to rash driving or user negligence. The user is liable to pay for it and deducted from the security amount .If security deposit is not charged then user has to pay for it during returning the vehicle to the service provider.

If any accidents/mishaps occured during the period of renting. The user is liable to pay for the damages to service provider and any third party involved.
 

License And ID Validation

If the License and ID is not find valid Finchant reserves the right to cancel booking. The 25% of the amount is deducted including the convenience fee and rest will be refunded to your bank account for which details provided by you.

If the License and ID is not find valid during the pickup time Finchant service provider reserves the right to cancel booking. The 100% of the booking amount deducted as penalty.

Finchant does not allow multiple accounts having the same driving license. In such cases, Finchant reserves the right to cancel the booking. Additionally, on account of user behaviour, Finchant can block certain licenses from booking. If a blocked user is found to have made a booking, the booking will be automatically cancelled. All cancellation charges will apply.

Limited Liability Of Finchant

Finchant always acts as a facilitator by connecting the User with the respective service providers like scooters, bikes and cars . (collectively referred to as "Service Providers"). The transaction is always between the self driven vehicle service provider and the User. Finchant's liability is limited to providing the User with a confirmed booking as selected by the User.

Any issues or concerns faced by the User at the time of availing any such services shall be the sole responsibility of the Service Provider. Finchant will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on part of any Service Provider.

Finchant does not operate self driven vehicle services on its own. In order to provide a comprehensive choice of self driven vehicle services, self driven vehicle types and prices to User, it has tied up with many self driven vehicle service providers.

It is the sole responsibility of the self driven vehicle service provider to ensure it has all the requisite licenses, approvals, insurance and permits from appropriate authorities required to undertake the booking. Finchant gives no warranty or assurance in regard to requisite licenses, approvals, insurance and permits which the self driven vehicle service provider is supposed to obtain from appropriate authorities.

Finchant will not be liable to User or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by User through usage of Website, in so far as such information is provided by the Service Provider.

In case of break down or accident of vehicle where Service Provider has been unable to make alternative arrangement, Finchant shall provide proportionate refund to User for remain time period. Any claims, liabilities or legal costs arising out of such event shall be borne by the Service Provider.

Unless explicitly committed by Finchant as a part of any product or service:

    Finchant assumes no liability for the standard of services as provided by the respective Service Providers Or Supplier.
    Finchant provides no guarantee with regard to their quality or fitness as represented.
    Finchant doesn't guarantee the availability of any services as listed by a Service Provider.

By making a booking, User understands Finchant merely provides a technology platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not Finchant. Thus the ultimate contract of service is between User and Service Provider.

If the User disagree with the above mention points User does not use Finchant's platform (website/app) to get any services.

 

 

 

Terms And Conditions For Taxi Cars

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

For the avoidance of doubt, ‘you’ or 'User' or 'Yours' refers to the person paying for the rental and/or the person making the booking. The term "We", "Us", "Our" shall mean Finchant Online Private Limited Or Finchant."Service Provider" means all the taxi or cab service provider who provides their vehicles with drivers to user.

In respect of the Services, when You make a Booking of taxi, we enter into a separate contract with You on behalf of the Service Provider as its disclosed agent, and the Service Provider is the principal. Together, these are referred to as ‘our terms’. The Service Provider’s house rules and cancelation policy (the “Service Provider Policies”) will also apply to the contract, unless stated otherwise in these Terms. We may change the terms from time to time and you are advised to check the website to consider any changes to the terms which apply to you. Your hire of any taxi is subject to the terms & conditions of taxi imposed by the taxi service provider and to the corresponding laws of the country and/or state in which the rental takes place.


These terms apply to any booking that you make with us on or through Finchant's website/app, so you should make sure that you are aware of their contents. Both our terms and those of the taxi service providers we work with contain some exclusions and limitations of liability.


User

The user automatically after doing booking is agreeing on this rental terms. If you do not agree with any part of them, you must not proceed with your booking. By confirming that you wish to book a taxi through Finchant's website you indicate that you have read and understood and accept our terms. If there is any part that you do not fully understand, or if you have a query about the taxi hire or any other product, please Contact us.


Age

You must ensure that any Passengers under the age of 18 are accompanied by a responsible adult.

All Passengers must be fit to travel. The Service Provider, whether through a Driver or other Service Provider personnel, acting reasonably, reserve the right to refuse the Services to any person who is considered unfit to travel, or who is abusive, intoxicated, underage, or if carriage of any such Passengers and / or luggage would cause the Driver or Service Provider to be in breach of any applicable laws, traffic and / or road safety regulations, or may damage the Vehicle. We will not be liable for the completion of any travel arrangements, nor for any refund, compensation, or any other costs whatsoever that You and / or any of the Passengers (as appropriate) may incur in such circumstances.


Documents Required

The user must carry his/her original or valid ID proof(Aadhaar Card,Pan Card, Voter Id & Passport) during the trip and present the same to the Taxi Service Provider or driver of the Taxi before boarding the Taxi.

Only Documents issued by the government of India such as Voter ID, Driver’s license,Pan Card, Aadhaar Card & Passport will be considered as valid ID proof only.

In the event of a mismatch in the identity of the User or traveler, the Taxi Service provider or the driver of the Taxi may, at their discretion, deny boarding to such User.


Accuracy Of Information

The User expressly undertakes to provide Finchant with correct and valid information while making Booking on Finchant website/app, and not to make any misrepresentation of facts. Any default on part of the User would disentitle the User from availing the taxi services from Finchant.

In case Finchant discovers or has reasons to believe at any time during or after receiving a booking request for taxi services from the User that the request for taxi services is either unauthorized or the information provided by the User or any of the travelers is not correct or that any fact has been misrepresented by that User, Finchant shall be entitled to appropriate legal remedies against the User, including cancellation of the bookings, without any prior intimation to the User. In such an event, Finchant shall not be responsible or liable for any loss or damage that may be caused to the User or any other person in the booking, as a consequence of such cancellation of booking or services.

The User shall not hold Finchant responsible for any loss or damage arising out of measures taken by Finchant for safeguarding its own interest and that of its genuine customers. This would also include Finchant denying or cancelling any bookings on account of suspected fraud transactions.


Bookings

All bookings have to be made solely by the registered user themselves via Finchant's Website, Android platforms well in advance and prior to boarding. Bookings are processed by Finchant's system automatically on a first come first serve basis. Finchant does not guarantee the availability of any particular vehicle at any given time. Vehicle availability is dynamically updated in Finchant's system to reflect real-time changes.

You must ensure that You have provided us with full and accurate details of the requirements for Your Booking, including, but not limited to, accurate timings (using the local time applying at the Pick-up location) for the Pick-up time, Pick-up location, Drop-off location, and, where applicable, flight number, train times, or ferry times. You must ensure that You check that Your Booking details that we confirm with You are complete and accurate.

Neither we nor the Driver or Service Provider are responsible for failed Rides if the details You have provided in the Booking are incorrect or You have failed to inform us, the Driver or Service Provider sufficiently or in time of a desired change to Your Booking.

You must ensure that the Passengers are at the Pick-up location at the Pick-up time. In the case of Pre-booked services in the event of a flight delay that is beyond Your control, providing You have provided us with Your flight details via the Platform at least 24 hours before the Pick-up time, the Service Provider will adjust the Pick-up time to factor in any delays. In the event Your flight is canceled or diverted, the Service Provider may not be able to honor Your Booking, in these circumstances, please contact our Customer Support Team.

You must provide us with valid and up-to-date contact information to enable us and / or the Service Provider (or their Drivers) to contact You if necessary and provide You with information regarding Your Booking.

You must ensure that You have chosen the appropriate Vehicle category for Your needs. When choosing Your Vehicle category, You should consider the number of Passengers traveling in the Vehicle and the amount of luggage space required, and check that the Vehicle meets Your needs.

You are responsible for ensuring that the Passengers comply with all provisions of the Terms where necessary or required to enable You to comply with the Terms, and You shall be liable for all acts and omissions of the Passengers.

Make sure You’re happy. Although we strive to ensure the accuracy of the information on our Platforms, neither we nor our affiliates, service providers, or agents can be held responsible by You for the accuracy of such information. The images displayed on our Platforms are for illustrative purposes only. It is solely Your responsibility to evaluate the accuracy, completeness, and usefulness of all information provided on our Platforms. In particular, for Public transit services, We cannot be held responsible if any of the facilities listed on our Platforms are out of order at the time of Your travel.


Pickup Or Boarding Of Taxi

Contacting You and the use of Your cell phone at the Pick-up location. You must ensure that You and / or the Passengers (as appropriate) have a telephone, with the contact number You have provided in the Booking, switched on, with mobile network data access (and be able to receive calls and texts, and use data for live chat where applicable) at a reasonable time before and at the Pick-up time and for the duration of any waiting time as set out below—this is so that the Driver can contact You, or You can contact the Driver if necessary. We cannot guarantee the feasibility or possibility of contact with Drivers via WhatsApp, or similar messaging applications and such communications are at Your own risk. You acknowledge that Your mobile network provider may charge additional fees for use of Your mobile data and network access at the Pick-up location; we are not responsible for such charges.

User shall board the Cab on or within such time as informed at the time of booking or provided in the booking voucher. In case the User fails to board the cab within the given timeline, Cab Operator will have the liberty to cancel the booking without informing the User.

The Driver is not obliged to wait for You beyond the Pick-up time, however the Driver will wait for the Passengers if Your Pick-up location is at an airport. Due to high passenger numbers at certain airports and the strong likelihood of delays reaching the arrivals hall.


Amendments (changes to your booking)

You can make changes to your booking after the booking rent amount is paid only when there is equal to or more than 7 days to board the vehicle.

You can not make changes to your booking after the booking rent amount is paid and there is less than 7 days to board the vehicle.

Once the taxi boarded by the user, changes in departure time, boarding or dropping points , extension and changing of taxi are not permitted.


Refund, Reimbursement And No-Show

Finchant is not liable to reimburse any expenses to user due to any vehicle breakdown, accident, damage or issues caused due to the vehicle or service.

If the booking is cancelled by the service provider due to vehicle non-availabilty due to any reason. We will process a full refund of the entire amount of the booking back to the original method of payment excluding the convenience or service charge. The refund will be processed within a maximum timeframe of 7-14 working days.

Any failure by User to board the Vehicle within the given timelines at the boarding point or trip commencement point, shall result in forfeiture of the total booking amount paid by the User without any refund rights.

A ‘No-show’ is when you:

   wish to cancel but don’t tell us before your rental is due to start, or
   fail to board the taxi up at the arranged time and date, or
   fail to provide the documentation that’s required to proof your identity during boarding the taxi.

In all instances of a ‘No-show’, you’ll receive no refund of the money you’ve paid.


Vehicles Use

Taxi booking are solely for the purpose of personal travel use. The vehicle cannot be used as a taxi or for transporting people for monetary gain. Vehicles cannot be used for For the purpose of transportation of any goods including any flammable, poisonous, or otherwise hazardous substances.

The vehicle cannot be used for any activity which is deemed illegal by the Indian Penal Code(e.g., trafficking or transporting illegal substances). The terms of vehicle use listed above are non-exhaustive. Any activity judged inappropriate by Finchant in its sole discretion will be deemed as a violation of agreement. Illegal use of the vehicle will be reported to the concerned authorities by Finchant followed by the suspension or termination of service immediately.

The taxi or vehicle entry restrictions may be applicable in different state/districts; You ust Contact Customercare Centre if you intend to do this. Additional documentation may be required and local charges may apply for travel to certain state/districts where restrictions are applicable.

The taxi booking should be undertaken in the User's personal capacity to travel and shall not be used for profit making in any commercial context.


User Responsibilities

You must arrive on time at the appointed pick up point as mutually agreed with Service Provider.

You must be respectful to Service Provider personnel at all times and not cause any nuisance, property damage, or otherwise behave inappropriately to the Driver, other Service Provider personnel, or the Service Provider during the trip and on failure to do so, Service Provider may require such User to disembark the taxi.

You must not contact the Driver or Service Provider for purposes other than the Service.

You must check the starting time and the reading on the odometer at the start of the trip. Disputes regarding the same will not be acceptable after completion of journey.

You prior to commencement of trip, check and agree with Service Provider on dimension/weight of the luggage that can be accommodated in the boot space of the taxi.

You must not use the Platforms to cause nuisance, annoyance, inconvenience, or make fake Bookings.

You must not use the Service or the Platforms for purposes other than obtaining the Service and You must only use the Service for the purpose for which it is intended to be used.

You must not ask Service Provider or their driver to violate any traffic rules, or the city police or government rules or other applicable laws for any reason whatsoever.

You must not coerce Service Provider to overload the boot space of the Vehicle with the User's luggage

use services offered under this head for any purpose which is unlawful or illegal under the applicable laws;

You must not board taxi under the influence of (a) Alcohol and/or (b) Any mind altering substance which can impair the your ability to travel. Use of narcotic substances is strictly prohibited. If you found to be under the influence of these substances, Finchant service provider or driver will not grant boarding of the vehicle to you. The booking fee will be reimbursed to the your account as per Finchant’s Refund Policy and you can be blocked from making any bookings with Finchant. Incase you consume alcohol after the ride has started and gets into any unexpected events then you will be solely responsible for all outcomes thereon (injury to self ,injury to others ,police involvements etc).

You will not be allowed to carry the following items on the vehicle: Weapons or any sharp or inflammable object which may cause damage to the vehicle or endanger human life. Any item/object whose possession has been deemed illegal by the Indian Penal Code. Any item or object which compromises the stability, safety or performance of the vehicle and/or the passengers. Finchant service provider holds the right to refuse the booking if you found to possess any of the above items. In the case of non-compliance, appropriate actions may be taken against you by the concerned authorities.


Safety

The Safety of users and passengers is a top priority. All vehicles are examined periodically in order to ensure that they are in compliance with India’s vehicle safety standards.

Finchant expects its users to ensure the following to help us avoid safety issues: (i) The user must ensure that all passengers wear safety belts or helmets. (ii)The number of passengers must not exceed the seating capacity of the vehicle.


Taxi Rental Charge And Payment

Booking of a taxi can either be "Prepaid", or "Part Payment" as per the options made available by the taxi service provider on the Website/App of Finchant.

In "Prepaid" model, the total booking amount is paid by the User at the time of booking itself. Such total booking amount includes the base fare, applicable taxes, and any additional booking fee, service or convenience fee charged by Finchant.

In "Part Payment" model, the User is required to pay a specific percentage of the total booking amount at the time of making the booking and balance payment shall be made directly to the driver at the time of boarding.

Any booking is subject to applicable cancellation policy set out on the booking page or as communicated to the User(s) or as mention in cancellation and refund policy section on terms and conditions page.

In case of Road trip and Outstation taxi bookings, the booking amount paid does not include toll charges, interstate taxes, passenger taxes or any other applicable levies and the same shall be borne by the User.

Expenses like toll charges, permit charges, parking charges, entry fees, Service Tax & any other Government Tax as per Government guidelines are to be borne by the User and paid directly to the driver.

The estimate cost provided at the time of booking is not to be construed as the final pricing for your trip unless specifically indicated. The final amount for your trip will be calculated based on actual usage (number of Kilometers and hours). Distance and time are calculated from garage to garage and not from the pick-up of the User for both within city and outside city trips.

The travel allowance wherever applicable has to be paid directly to the driver.


Limited Liability Of Finchant

Finchant always acts as a facilitator by connecting the User with the respective taxi service providers (collectively referred to as "Service Providers"). The transaction is always between the taxi service provider and the User. Finchant's liability is limited to providing the User with a confirmed booking as selected by the User.

Any issues or concerns faced by the User at the time of availing any such services shall be the sole responsibility of the Service Provider. Finchant will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence on part of any Service Provider.

Finchant does not operate taxi services on its own. In order to provide a comprehensive choice of taxi services, taxi types and prices to User, it has tied up with many taxi service providers.

It is the sole responsibility of the taxi service provider to ensure it has all the requisite licenses, approvals, insurance and permits from appropriate authorities required to undertake the booking. Finchant gives no warranty or assurance in regard to requisite licenses, approvals, insurance and permits which the taxi service provider is supposed to obtain from appropriate authorities.

Finchant will not be liable to User or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by User through usage of Website, in so far as such information is provided by the Service Provider.

In case of break down or accident of vehicle where Service Provider has been unable to make alternative arrangement, Finchant shall provide proportionate refund to User for remain time period. Any claims, liabilities or legal costs arising out of such event shall be borne by the Service Provider.

Unless explicitly committed by Finchant as a part of any product or service:

    Finchant assumes no liability for the standard of services as provided by the respective Service Providers Or Supplier.
    Finchant provides no guarantee with regard to their quality or fitness as represented.
    Finchant doesn't guarantee the availability of any services as listed by a Service Provider.

By making a booking, User understands Finchant merely provides a technology platform for booking of services and products and the ultimate liability rests on the respective Service Provider and not Finchant. Thus the ultimate contract of service is between User and Service Provider.

If the User disagree with the above mention points User does not use Finchant's platform (website/app) to get any services.

 

 

Cancellation And Refund Policy

We would love to be part of your travel plan but in case your plans change, our simple cancellation process makes sure you receive a quick confirmation and fast refunds.

Every Service Provider has its own cancellation and refund policy for that you visit the package or service details page.

If they have not provided then cancellation and refund policy under this section apply to the service or package.

 

A) For Self Driven Vehicle And Taxi

For Bookings Less than 24 hours to pickup time.

We do not charge cancellation fees for bookings cancelled within 30 minutes of creating the same booking. 100% of amount paid will be refunded excluding the convenience charges.

After 30 minutes 100% of the booking amount  will be charged.

If token amount paid, then 100% of token amount  will be charged.

If Supplier cancels the booking then 100% of amount paid will be refunded excluding the convenience charges.

 

For Bookings More than 24 hours and Less Than 4 days(96 hours) to pickup time.

50% of the booking amount will be charged rest will be refunded.

If token amount paid, then 100% of token amount  will be charged.

 

For Bookings more than 5 days to pickup time.

25% of the booking amount will be charged rest will be refunded.

If token amount paid, then 100% of token amount  will be charged.

 

How to Cancel

You can cancel your booking by calling us on +91-7017365715 to cancel your booking. The applicable refund amount will be credited to you within 7-14 working days.

Cancellation By Finchant.com

Finchant.com reserve writes to cancel booking incase voilation of the policies.

In case a user fails to show up for his reservation or cancels the ride 24 before the pickup time, the booking shall be treated as a No Show no amount will be reimbursed.

In case a ride is cancelled due to inability to produce an Original valid license or valid Govt. Id during ride pickup, 100% deductions will be applicable.

If a user with blocked license makes a booking, the ride would be cancelled with 100% deductions

 

When user wants to cancel the booking after picking up the vehicle

100% of the booking amount is deducted. No Refund applicable
